Table Needs, Inc. – Terms of Service
We, Table Needs, Inc. (“Table Needs,” “we,” “us,” or “our”), welcome you to our services. By engaging with our offerings—whether marketing services, point-of-sale (POS) software, hardware, or other products—you agree to comply with and be bound by these Terms of Service (“Terms”). We ask that you read these Terms carefully before using our services.
1. Acceptance of Terms
By accessing or using any of our services, you agree to be bound by these Terms, including any applicable Service Addendum (as defined below). If you do not agree with any part of these Terms, we request that you refrain from using our services.
2. Services Provided
We provide a variety of services, including marketing solutions and POS software and hardware offerings. The specific services we deliver to you (“Client” or “Customer”) depend on the package or product you select. We outline the scope, deliverables, and limitations of each service in the relevant Service Addendum, which is either attached to these Terms or provided separately at the time of your purchase or subscription.
3. Client Responsibilities
You agree to fulfill the responsibilities associated with your selected service(s) as detailed in the applicable Service Addendum. These may include providing us with timely materials, feedback, or account access, as well as ensuring the proper use and security of any software or hardware we provide.
4. Fees and Payment
- Payment Terms: You agree to pay all fees and charges for the services you select, as specified in the applicable Service Addendum or a separate quote provided by us. We will indicate the payment schedule (e.g., monthly or one-time) and due dates therein.
- Late Payments: If payments are late, we may pause or terminate your services until we receive full payment.
- Taxes: You are responsible for any applicable taxes related to the services or products we provide.
- Additional Services: Should you request services beyond the scope of your selected package, we will provide a separate quote.
5. Term and Termination
- Term: These Terms commence on the Effective Date (the date you first engage our services) and continue as specified in the applicable Service Addendum (e.g., month-to-month or fixed term) unless terminated.
- Termination by Either Party: Either you or we may terminate these Terms by providing 30 days’ written notice, unless the Service Addendum specifies otherwise.
- Immediate Termination: We reserve the right to terminate these Terms immediately if you breach any provision herein or fail to make timely payments.
- Cancellation Process: We will outline specific cancellation procedures (e.g., returning leased hardware) in the applicable Service Addendum.
6. Content Approval and Revisions
For services involving content creation or updates (e.g., marketing or website design), we will specify the approval and revision processes in the applicable Service Addendum. You agree to provide us with timely feedback or approval as outlined therein.
7. Confidentiality
We and you agree to maintain the confidentiality of all proprietary or sensitive information shared during the course of these Terms. This obligation remains in effect after termination.
8. Limitation of Liability
- We shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, even if we are advised of the possibility of such damages.
- Our total liability under these Terms shall not exceed the total fees you have paid to us in the preceding three (3) months, unless the Service Addendum states otherwise.
- We provide specific liability limitations (e.g., for hardware malfunctions or software interruptions) in the applicable Service Addendum.
9. Dispute Resolution
Should any dispute arise from these Terms, we will first attempt to resolve it through good faith negotiations. If we cannot reach a resolution, the matter shall be submitted to binding arbitration in Alabama, conducted in accordance with the rules of the American Arbitration Association.
10. Governing Law
We govern and interpret these Terms in accordance with the laws of the State of Alabama, without regard to its conflict of law principles.
11. Changes to Terms
We may update these Terms from time to time without prior notice. It is your responsibility to review these Terms periodically for changes. Your continued use of our services constitutes acceptance of any updates.
12. Entire Agreement
These Terms, together with any applicable Service Addendum, constitute the entire agreement between you and us, superseding all prior agreements, representations, and understandings.

Service Addendum A: Marketing Services
A1. Available Tiers
We offer the following marketing service tiers:
- Marketer Lite:
- Services: We provide marketing strategy (market research, brand enhancement, campaign planning); website design and hosting on our platform (mobile-optimized, quarterly updates); access to our social media tools/templates; monthly analytics reports; live monthly group training; and access to our private Facebook group.
- Fees: We charge a $500 setup fee plus $125 per month.
- Your Responsibilities: You must provide us with branding materials, high-quality images, timely feedback (within 3 days), access to website accounts, and participation in our trainings or group discussions is highly encouraged.
- Marketer Complete:
- Services: We provide marketing strategy (market research, brand enhancement, campaign planning); full-service social media (management of 2 platforms, 12 posts/month, up to 3 hours/month community engagement); website design, hosting, and ongoing maintenance; monthly analytics reports; quarterly goal reviews; monthly consultations; and access to our private Facebook group.
- Fees: We charge a $500 setup fee plus $499 per month.
- Your Responsibilities: You must provide us with branding materials, high-quality images/videos, timely feedback (within 3 days), access to social media and website accounts, and participation in our scheduled meetings.
A2. Payment Terms
- Marketer Lite and Complete: We will automatically draw payment monthly on the same date as your initial payment (e.g., if your first payment is on the 18th, we will charge you on the 18th of each subsequent month).
A3. Content Approval and Revisions
- We submit content via email (Marketer Lite) or our Approval Portal/email (Marketer Complete).
- You must provide feedback or approval to us within 3 days.
- Website updates outside scheduled meetings require a 72-hour turnaround by us.
- For Marketer Complete, new content or major revisions require a 48-hour turnaround by us.
A4. Term
We provide these services on a month-to-month basis unless terminated with 30 days’ notice.
Service Addendum B: Point-of-Sale (POS) Software and Hardware
B1. Services Provided
- We offer POS software subscriptions.
- We provide hardware equipment (e.g., iPads, card readers) for sale or lease.
B2. Fees
- We specify fees on our website or in a separate quote provided to you.
- We require monthly subscription payments; hardware lease payments are due per the lease agreement.
B3. Your Responsibilities
- Data Security: You must maintain the security of your account credentials.
- Hardware Maintenance: You are responsible for caring for equipment we provide; you must report issues to us promptly and are liable for damages due to misuse or neglect.
B4. Liability Limitations
- Software: We are not liable for loss, damage, or interruption from software use; you ensure hardware/network compatibility.
- Hardware: We ensure quality at sale/lease but are not liable for post-delivery damages or malfunctions.
B5. Cancellation
- You may cancel your subscription by contacting us at support@tableneeds.com.
- For leased hardware, your final payment is due once we receive the returned equipment.
B6. Term
We provide these services on a month-to-month basis unless terminated with 30 days’ notice or per the lease agreement.
